## Terms of Use for [Unser-NB.de](http://Unser-NB.de) The platform [Unser-NB.de](http://Unser-NB.de) is operated by the city administration of the Vier-Tore-Stadt Neubrandenburg. It provides citizens, organisations in Neubrandenburg and the surrounding area with a free communication and work tool that supports civic engagement and voluntary activities in compliance with GDPR. These terms of use apply to the website [Unser-NB.de](http://Unser-NB.de) - [https://www.unser-nb.de](https://www.unser-nb.de), hereinafter referred to as "[Unser-NB.de](http://Unser-NB.de)" or "platform" - of the city administration of the Vier-Tore-Stadt Neubrandenburg. [Unser-NB.de](http://Unser-NB.de) represents an exchange and information platform. These terms of use regulate the relationship between the operators of the platform, the city administration of the Vier-Tore-Stadt Neubrandenburg, Friedrich-Engels-Ring 53, 17033 Neubrandenburg and the visitors and members (hereinafter referred to as "users"), as well as the behaviour of users among themselves. By registering on the platform, a contract with the following regulations is concluded between the users and the Vier-Tore-Stadt Neubrandenburg: ### 1\. Registration on [Unser-NB.de](http://Unser-NB.de) and acceptance of the terms of use By registering on [Unser-NB.de](http://Unser-NB.de), you agree to these terms of use. Use without agreeing to the terms of use is not possible. The user agreement is concluded for an indefinite period and can be terminated by either party at any time without notice. Use of the service by users who have not yet reached the age of 16 is only permitted under the supervision and with the consent of a parent or guardian. ### 2\. Scope of the terms of use a.) The terms of use apply to the platform, including its subpages. b.) The use of [Unser-NB.de](http://Unser-NB.de) is free of charge. c.) The terms of use apply from the beginning of the respective use. ### 3\. Range of services and availability of [Unser-NB.de](http://Unser-NB.de) a.) [Unser-NB.de](http://Unser-NB.de) is the volunteer and engagement platform of the Vier-Tore-Stadt Neubrandenburg. It serves users to organise their activities, to build and expand networks within the urban society and to share content with a broad and open user base. The services provided by the platform include, among others, the possibility for registered users to post different content such as images or texts, to rate content of other users, to comment or to participate in polls. Registered users of [Unser-NB.de](http://Unser-NB.de) also have the opportunity to get in touch with other users and search for content. b.) The Vier-Tore-Stadt Neubrandenburg strives to continuously develop the platform and adapt it to the requirements of the users. The website therefore represents a current state of development. However, users are not entitled to the offer remaining unchanged in its content and scope or having certain functions. There is also no entitlement to the offer always being accessible and functioning without errors. c.) The Vier-Tore-Stadt Neubrandenburg reserves the right to no longer provide the offer or parts of it. Should such a case occur, the rights of those affected with regard to personal data are regulated in the data protection provisions. ### 4\. Third-party offers a.) The Vier-Tore-Stadt Neubrandenburg reserves the right to cooperate with third-party providers. Should users use the offers of third parties, the Vier-Tore-Stadt Neubrandenburg is neither a contractual partner nor a vicarious agent. The terms and conditions of the third party apply. There is no obligation to perform on the part of the Vier-Tore-Stadt Neubrandenburg in this context. b.) The Vier-Tore-Stadt Neubrandenburg does not use third-party analysis and advertising tools on the platform and will not do so in the future. c.) The Vier-Tore-Stadt Neubrandenburg does not place third-party advertising, for example in the form of advertising banners or overlays, on the platform and will not do so in the future. d.) The Vier-Tore-Stadt Neubrandenburg does not pass on email addresses or other personal data to third parties for advertising purposes, especially not for direct marketing purposes. ### 5\. Obligations of the users a.) Users undertake to truthfully fill in the necessary information during registration. Furthermore, they undertake not to violate the personality rights of third parties by providing false information. b.) Users assure that the content they post, in whatever form, does not violate the copyright of third parties. Users are responsible for the content they provide. The Vier-Tore-Stadt Neubrandenburg assumes no responsibility for this. This applies in particular to the possible violation of copyrights, as well as the accuracy of the content. c.) Users undertake not to post any content, in whatever form, on the platform that violates applicable law and good morals. This includes, but is not limited to: - Calls for drug use - Calls for acts of violence - The distribution of unconstitutional material under German law - The sharing of political content, especially party advertising - The distribution of spam - The distribution of sexual, violent or weapon-glorifying content d.) Users undertake to behave in a friendly and politically correct manner towards other users. This includes, among other things, but is not limited to: - Insults - Refraining from discrimination regarding age, gender and origin - Refraining from discrimination regarding religious affiliation - Bullying - Stalking e.) Users are prohibited from distributing advertising for commercial offers from third parties. f.) Users undertake to behave in accordance with the purpose of the platform mentioned under 3.a.). Religious, political or other discussions that are thematically distant from this purpose are not desired. ### 6\. Multiple accounts, email address and passwords a.) Each user may only register once simultaneously on the platform. b.) If users have forgotten their passwords, they can use the "Forgot password" function to reset them. A valid email address is necessary for this process, for which the users are responsible. Forgotten access data will not be manually reset by employees of the Vier-Tore-Stadt Neubrandenburg. ### 7\. Rights of the Vier-Tore-Stadt Neubrandenburg a.) In case of violations of these terms of use, laws and/or other rules published on the platform, the Vier-Tore-Stadt Neubrandenburg can temporarily or permanently block users from using the platform. Likewise, the Vier-Tore-Stadt Neubrandenburg has the right to delete a user account, posts and functions at any time, especially in case of violations of the terms of use. b.) Likewise, the Vier-Tore-Stadt Neubrandenburg has the right to modify or remove posts and provided content if they violate the terms of use or applicable laws. The Vier-Tore-Stadt Neubrandenburg also reserves the right to assess the classification of the specifications for content at its own discretion. ### 8\. Granting of rights By creating content on the platform, users grant the Vier-Tore-Stadt Neubrandenburg a simple, temporally and spatially unlimited and free right to use the created content within the framework of the platform. By granting these rights, the Vier-Tore-Stadt Neubrandenburg does not adopt the content of the users as its own in the sense of liability standards. The granting of rights only serves to facilitate the administration and use of the content when operating the platform. ### 9\. Termination of the user relationship a.) The Vier-Tore-Stadt Neubrandenburg can exclude users from using the platform at any time without giving reasons. In such a case, the personal data of the user will be deleted. This procedure is particularly applied in case of violations of the terms of use. b.) Users can terminate their membership on the platform at any time through the profile settings. The personal data will be deleted upon termination. c.) If users are unable to delete their accounts, they can contact an employee of the Vier-Tore-Stadt Neubrandenburg at any time. If users do not use the platform's offer for more than a year, the Vier-Tore-Stadt Neubrandenburg reserves the right to delete the user profile including its personal data. In this case, the city administration will send a prior reminder with appropriate advance notice to the email address stored in the profile. The user is responsible for ensuring that the email address is valid and regularly checked. ### 10\. Limitation of liability a.) Users acknowledge that the Vier-Tore-Stadt Neubrandenburg is not liable for content that was not created by it. b.) With the exception of injury to life, body and health and the violation of essential contractual obligations (cardinal obligations), the Vier-Tore-Stadt Neubrandenburg is only liable for damages that are attributable to intentional or grossly negligent behaviour. This also applies to indirect consequential damages, such as lost profits in particular. c.) The limitation of liability in these terms applies analogously in favour of the employees and vicarious agents of the Vier-Tore-Stadt Neubrandenburg. ### 11\. Indemnification a.) If the Vier-Tore-Stadt Neubrandenburg has to answer for actions of the user (e.g. due to the use of a copyrighted photo by users), the user indemnifies the Vier-Tore-Stadt Neubrandenburg from all claims as well as the necessary costs incurred in connection with the defence against claims that third parties assert against the Vier-Tore-Stadt Neubrandenburg due to a legal violation for which the user is responsible. The necessary costs include, in particular, court and lawyer fees in the statutory amount. b.) Users are also obliged to inform the Vier-Tore-Stadt Neubrandenburg truthfully, immediately and completely about the legal violation and about all circumstances that are useful for the defence against the claims of the third party, and to provide necessary materials for this purpose. ### 12\. Changes to these terms of use a.) The Vier-Tore-Stadt Neubrandenburg is entitled to change the terms of use and the privacy policy. The adjustment will only be made if there are valid and factual reasons and if it does not disturb the contractual balance of the user to the operator. Such reasons can be, for example, legal and technical changes, experiences with usage behaviour or unintended gaps in the clauses. The change will be communicated to the users by email and/or during the next visit to the website. b.) Users are entitled to object to the changes. In case of objection, the Vier-Tore-Stadt Neubrandenburg reserves the right to terminate the contractual relationship existing between the user and the Vier-Tore-Stadt Neubrandenburg with immediate effect. ### 13\. Data protection The Vier-Tore-Stadt Neubrandenburg is aware of the applicable data protection regulations. The Vier-Tore-Stadt Neubrandenburg will comply with the legal provisions of data protection in the currently applicable version. ### 14\. Applicable law The law of the Federal Republic of Germany applies to the contractual relationships between the Vier-Tore-Stadt Neubrandenburg and the users, insofar as no mandatory regulations conflict with this. ### 15\. Severability clause Should one or more provisions of this contract be or become invalid, this shall not affect the validity of the remaining provisions. The contracting parties are obliged to replace the invalid provision with a valid provision that best achieves the contractually intended result.
